Consequences of driving drunk in California


California has specific drinking and driving laws and penalties for people who have been convicted of a DUI/DWI. There are minimum and maximum fines and penalties that are at the discretion of the judge and prosecuting attorney depending on many different factors and circumstances surrounding the case.

First Offense: 1st offense drinking and driving convictions can lead to 96 hours of mandatory jail time up to one year a fine of 390-1000 and the driving privileges revoked for up to one year.

Second Offense: If you have been pulled over for your second drinking and driving infraction within 10 years of the first conviction in California, you can face the following consequences. Driving privileges are revoked for up to 2 years, 90 days in jail up to one year of incarceration, with fines ranging from $390 -1000 dollars.

Third Offense: 3rd driving while intoxicated penalties are 120 days in jail, up to one year, revoked driver’s license for 3 years, and a fine ranging from $390 to 1000 dollars.

Fourth (or more) Offense: 4th and subsequent DWI infractions in California- 180 days in jail up to one year, driver’s license revoked for 4 years, and a fine minimum of $390 and a maximum of $1000.
