For a second OUI, the courts are mandated to give 7 days in jail to the defendant and have the option to mandate incarceration for up to one year.

Third Offense: 3rd time drinking and driving offenses (DUI) is considered a Class C crime and punishable by up to 5 years in prison with a minimum of 30 days incarceration in county jail. The fines for a 3rd OUI can range in cost from $1,100 up to $5,100, not including the mandated treatment program costs. Driving privileges are revoked for 4 years.
