Delaware has specific drinking and driving laws and penalties for people who have been convicted of a DUI/DWI. Second Offense: If you have been arrested for a 2nd DWI in Delaware within 10 years of the first conviction you can face imprisonment for a term of no less than 60 days and up to 18 months incarceration. Fines from $750-$2,500, driving privileges revoked for 18 months. If your BAC is above .15 there may be longer revoked driving privileges.

Third Offense: 3rd DUI conviction in Delaware within 5 years of a previous conviction will result in a jail term of no less than 1 year and up to 2 years, fines up to $5,000. The court has at its discretion to suspend 9 months of the incarceration sentence if treatment or other conditions are followed through including probation. 3rd time DWI offenders will have their license suspended for 24 months.
